PART 2: TICKETING TERMS AND CONDITIONS These Ticketing Terms and Conditions (“Ticketing Terms”) apply to all ticket purchases made through the Site. By purchasing tickets you agree to be bound by these Ticketing Terms and the Website Terms and Conditions in Part 1 above. Please read both carefully before completing your purchase. 12. Definitions In these Ticketing Terms, in addition to the definitions in Part 1: • "Box Office" means the box office at the venue at which the Performance is to take place. • "Performance" means the event on the date and at the time for which a Ticket is purchased. • "Ticket" means a ticket or tickets purchased through the Site for admission to a Performance. • "we/us/our" refers to the St Endellion Festivals Trust, registered charity number 1124805, registered address 16 Burgh Street, London N1 8HF. • "you/your" means the person purchasing a Ticket. 13. Your Purchase Contract 13.1 A contract for the purchase of Tickets is formed when we confirm your order by email. Until such confirmation is sent, no contract exists. 13.2 All Ticket purchases are subject to payment verification and security checks. We reserve the right to cancel any transaction which we reasonably suspect to have been made fraudulently or in error. 13.3 We reserve the right to decline any order at our discretion, including without limitation where we have reason to believe it does not comply with these Ticketing Terms. 13.4 Personal data provided in connection with your purchase will be processed in accordance with our Privacy Policy. 14. Tickets 14.1 All Tickets are sold subject to availability. 14.2 Every person attending a Performance, including children, must hold a valid Ticket. 14.3 Where a concession is claimed, proof of identity and entitlement may be required at the Box Office. 14.4 Tickets are sold subject to our right to make alterations to the advertised programme, performers or timing. 14.5 We may impose a maximum number of Tickets per order. Any such restriction will be notified at the time of booking. We reserve the right to cancel Tickets purchased in excess of any stated limit, unless such excess resulted from our error. 14.6 Any known restrictions on a Ticket — such as restricted, obstructed or side-on views, or a minimum age requirement — will be notified to you on the Site at or before the time of booking. 14.7 A Ticket entitles the holder to a seat of the value stated on the Ticket. We reserve the right to allocate alternative seats to those shown on the Ticket, whether before or during the Performance. 14.8 Please check your Tickets carefully on receipt, as errors may not be capable of correction after purchase. Please contact us immediately if there is an error. 14.9 Tickets must not be resold or transferred for profit or commercial gain. Any Ticket resold or transferred in breach of this condition will become void and the holder may be refused admission or asked to leave the venue. 15. Price and Payment 15.1 The price of a Ticket is the price displayed at the time we accept your order, except in the case of obvious error. If we discover an obvious pricing error, we will contact you promptly and give you the option of confirming your order at the correct price or cancelling it. 15.2 All prices are inclusive of VAT (where applicable) and include any applicable booking fee. 15.3 We accept payment by Visa, Mastercard and American Express. Full payment is required before an order will be accepted. 16. Delivery of Tickets 16.1 Tickets will normally be sent by email to the address provided at the time of booking, immediately upon completion of payment, unless otherwise stated. 16.2 If you have not received your Tickets by email and they are not being held at the Box Office, please contact us at least 72 hours before the Performance. 16.3 If you are collecting your Tickets from the Box Office, please bring your order confirmation email and the payment card used to make the booking. 16.4 We reserve the right to make Tickets available for collection only at the Box Office. In such cases you will be notified by email in advance. 17. Cancellation, Exchanges and Refunds 17A Cancellations and Programme Changes 17.1 If a Performance is cancelled, we will, where possible and subject to availability, offer you a Ticket of equivalent value for an alternative Performance. If no suitable alternative is available, we will issue a refund of the Ticket price paid. 17.2 If there is a material change to a Performance, you may exchange your Ticket for an alternative Performance (subject to availability) of equivalent value, or receive a refund. A “material change” is a change which, in our reasonable opinion, makes the Performance materially different from what purchasers could reasonably have expected. The substitution of individual performers shall not of itself constitute a material change. 17.3 It is your responsibility to check whether a Performance has been cancelled or rescheduled. We will use reasonable endeavours to notify you of any cancellation or material change using the contact details you provided, but we cannot guarantee that you will be informed before the date of the Performance. 17B Exchanges 17.4 Requests to exchange Tickets (subject to availability) must be made by email to tickets@endellionfestivals.org.uk at least 48 hours before the Performance. 17C Refunds Policy 17.5 Tickets are non-refundable, except in the circumstances set out in clauses 17.1 and 17.2 above, or as required by law. 17.6 If you are unable to attend a Performance, you may return your Tickets for resale in accordance with clause 18 below. This is the only mechanism by which a refund may be obtained for Tickets returned at your own election. 17.7 Any refund due to you will be paid to the original purchaser by the same method as the original payment. 18. Return of Tickets for Resale 18.1 If you wish to return a Ticket, you must notify us by email to tickets@endellionfestivals.org.uk no later than 24 hours before the Performance. 18.2 Returned Tickets will be placed on sale only after all other available Tickets for that Performance have been sold. We will use reasonable endeavours to resell returned Tickets but cannot guarantee that any returned Ticket will be resold. 18.3 If we are able to resell a returned Ticket, we will refund the original purchaser the face value of the Ticket, less any applicable booking fees and an administration charge to cover our costs. The amount of any administration charge will be notified to you at the time you request a return. 18.4 If we are unable to resell a returned Ticket, no refund will be payable to the original purchaser. 18.5 Resale cannot be guaranteed. By returning a Ticket under this clause, you acknowledge and accept that you may receive no refund. 19. Liability 19.1 Our maximum liability to you in respect of the cancellation, rescheduling or material change of a Performance is limited to the face value of the Ticket(s) purchased, including any booking fee but excluding any postage or delivery costs. 19.2 Personal arrangements made by you in connection with attending a Performance, including travel, accommodation or hospitality, are entirely at your own risk. We accept no liability for such costs in any circumstances. 19.3 We do not accept responsibility for the loss, theft or damage of any personal property at or in connection with a Performance. 19.4 Nothing in these Ticketing Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. 20. Admission and Attendance 20.1 We reserve the right to refuse admission to Ticket holders on reasonable grounds, including for health and safety or licensing reasons, or where a Ticket is void. 20.2 We reserve the right to refuse admission to, or to remove from the venue, any person who is making unreasonable noise, causing a disturbance, or behaving in a violent, aggressive or unreasonable manner. 20.3 Latecomers may be admitted during a suitable break in the Performance, but admission cannot always be guaranteed. 20.4 By attending a Performance, Ticket holders consent to being filmed or sound-recorded as members of the audience. 20.5 Ticket holders must comply with all applicable statutes, safety regulations and venue announcements whilst attending a Performance. 20.6 Ticket holders may only leave and re-enter the venue at the discretion of the Box Office manager. No re-admissions will otherwise be permitted. 21. Restrictions at Performances 21.1 The recording or transmission of any audio, visual or audio-visual material inside the venue is strictly forbidden. Unauthorised recordings may be deleted or destroyed. Any recording made in breach of this clause shall belong to SEFT. 21.2 Mobile phones, tablets, messaging devices and other electronic equipment must be switched off or silenced whilst inside the venue. 21.3 Smoking and the use of e-cigarettes is prohibited inside the venue. 21.4 Audience members may not bring their own food or drink into the venue unless expressly permitted. 22. Queries and Complaints 22.1 If you have any queries or complaints about a Ticket purchase, please contact us at tickets@endellionfestivals.org.uk. 22.2 If you have any concerns during a Performance about your ability to see or hear it, please speak to the Box Office manager before or during the Performance. 23. General 23.1 These Ticketing Terms, together with the Website Terms and Conditions in Part 1, constitute the entire agreement between you and us in relation to your use of the Site and your purchase of Tickets. 23.2 If any provision of these Ticketing Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. 23.3 Our failure to enforce any provision shall not constitute a waiver of our right to do so. 23.4 A person who is not a party to these Ticketing Terms shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term. 23.5 These Ticketing Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
